Legal Problems In Business? Know What To Do

Businesses have to face different challenges each day and one such is the legal problems faced by business owners. Many businesses aren’t just sure which way to turn when it comes to facing legal issues simply because there isn’t a said list of things that you need to do when faced with such problems.

Legal Issues and its Many Forms
Legal issues do not have a said pattern it can come from anywhere and at times from the least expected places – a customer could have defaulted to send you the promised payment, a government agency could have a thing or two to say about your business which you need to defend, a former manager could have set up a similar business after stealing your clients and know-how, you could be facing a heavy lawsuit from someone be it client or customer, you have a dispute with your landlord, your business has been defamed on the internet, you are facing employee problems with the guy threatening to sue if you fire him…. you never know from where they come, but as a business owner there is a very high possibility that you will be needing some legal guidance one way or the other.

Go for Legal Help at the First Sign
It is important to act promptly when it comes to legal issues, as the more you delay the more complicated it will become. A delay will make it difficult to seek injunction from the court of law. Also for issues pertaining to a party to a contract it is imperative to act fast as the binding period of the contract may not be much. It is never a good idea to leave it a bit too late. Developing a legal strategy takes time in some cases hence it is best to act at the earliest sign of an issue, more the delay, more it is going to cost your business.

Have a Legal Team that Can be Consulted when the Need Arises
It is pertinent that you have a team of on-call lawyers, a team or a firm that you can depend on to jump in to your rescue when you face legal issues. Ensure that you have the phone numbers and email addresses of your trusted legal comrades. It is important though that you need to have the right people to consult. Your choice must be in line with the nature of business. Businesses in general will require an intellectual property lawyer who deals with copyrights, trademarks and patents and some may even require a tax lawyer as not all tax issues can be resolved by your accountant.

Know What to Expect when a Dispute Arises
Success in business is dependent on building relationships and those that you build with your lawyers are just as important as the ones that you build during your regular business processes. A good relationship with your lawyers will ensure that you do not lose sleep over the legal issues that you may or may not face in your business.

The Main Legal Difference Between Living Together And Marriages In US

The legal rights that are available for two people who are married or are living together is completely different in each country. In the same way, United States also has its own set of legal differences between the two. Some of the main points that will help you are listed below.

Legal Status
In the case of a married couple, you are required to have a civil marriage which will give you a proof of the marriage to have taken place. The marriage registration in the US or that which is done in any other country can be used as a legal status for a married couple. Living together is not legally recognized as a status. If required, you and your partner can sign a cohabitation contract which is generally signed by any two individuals who are living together in one place.

Banking
In the case of living together and if both the partners are holding independent accounts, then there can be no claims made by each other for the money in their individual accounts. In the case of a joint account, both of them can operate and use the money as long as available. In case of death, the other person can continue to use the amount deposited in the joint account. If the account has joint names then in case of the demise on one person, the other partner will get full access to the account.

In the case of married couples, the same principle as living together applies in case of joint accounts. In the case of individual account, the spouse can claim the amount of a death partner as well.

Children
Parental responsibility is usually applicable only if you are the birth mother of the child, husband of the child’s birth mother, a female partner who is married to the child’s birth mother and is a legal parent or an adoptive parent. You can get parental responsibility if you are an unmarried male or female who is married to the child’s birth mother. There are laws are applicable for having contact with the children, giving them financial support, appointing a guardian, inheritance, nationality and adoption.

Death and Inheritance
In the case of couple living together, if one partner dies without having made a will, then the surviving partner cannot inherit anything other than that which is held in the joint names. If at all a person inherits something from a partner, then they have to pay inheritance tax.

For married couples, if a spouse dies, the other will inherit whatever is left over and inherits that entire money or property that is left behind and can also avail exemption from inheritance tax.

The categories mentioned above are the most basic things that need to be taken care of in order to have a legal binding while living together or being married. The law also gives particulars about the debts, Domestic Violence, Ending a relationship, Financial Support, Housing, Legal Aid, Next of kin, Money and possessions, Names, Pensions etc. In addition to all these, welfare benefits, tax credits, student loans and grants, Taxes and witnesses have to be classified in a legal way.

Tips To Find Good Lawyers For Your Business

Lawyers are needed for any business and it is necessary that you have a team of lawyers who are able to take care of any legal issues that may arise in the general flow of business. As much as they are important, it is equally pertinent that you find the best ones that suit your business and requirements. Here are some tips that will help you find some good lawyers for your business.

Business Associates and Friends
People who have been in the business field for sometime will know a few names that are good at what they do. Asking around will help in reducing your research time and hence is the best way to find the good ones in the market.

Search the Internet
The internet is one of the best search tools available today. Use it to search for good lawyers in the area. You can go through reviews and possible client feedbacks on how some top names have done in cases that might be similar to the line of business that you are in. You can choose the names of lawyers who have abundant knowledge about the legal aspects that might be well suited for you. Choosing them might be the way to go if you do not have any references to begin with.

Check for Experience and Case Studies
Some top lawyers list out the top cases that they have won and argued in the past. This will tell a lot about their experience in the field and also being open about their clients and cases means that they are transparent and invariably good in their work. You can go through case studies that at times are published on the internet and can make an evaluation based on that.

Lawyers Referral Services
There are a few Lawyers Referral Services in the country that can be looked at as well. These services can help you find the ideal lawyer or a team of lawyers that will be best suited for your line of business. Some of these services have extensive experience in the field and will be able to provide names in no time.

Lawyer Networks
If your business is spread across geographical regions then it is best to choose a team from a firm that has a network of lawyers spread across regions. You can hire the firm and can use the expertise of people who are associated with the firm but are located elsewhere. For instance a lawyer network that spreads across the UK can help you deal with a case in Cardiff even though your parent firm association is in Birmingham.

Never Mind the Cost Factor
You will be wise to remember that the least expensive lawyers are the most unlikely ones to solve your legal problems for you. Skill and expertise has a price and you must be willing to pay it. Lawyers are unlike business products where there is a possibility for you to get good ones for lesser costs. If you want experience and expertise, then it is best for you to be prepared for the high consultancy fees that they will charge you.
